Terms

The agreement between you and Safe AI Labs Pty Ltd when you use the API.

Last updated 13 Oct 2026

This agreement

These terms are an agreement between Safe AI Labs Pty Ltd (ABN 79 697 222 601, "we") and the person or organisation that opens a workspace ("you"). By creating an account, buying credits, starting a plan or sending a request, you accept them.

If you accept for an organisation, you confirm you have authority to bind it. You must be 18 or over. The privacy policy forms part of these terms.

The service

Safe AI Labs gives you API access to hosted models in the region you choose. Every request runs in the region it is sent to. If the region has no capacity, the request fails with a retry time and is not sent to another region. A request sent to gbl runs in us-region if your key and workspace allow it.

The models are open-weight models published by others. Where a model's licence places conditions on its use or its outputs, those conditions apply to you. The docs list what each model supports.

Your account

  • Give a working email address and keep it current. We send notices under these terms to it.
  • Keep your API keys secret. You are responsible for every request made with your keys, whoever made it. Revoke a key as soon as you think it has leaked.
  • The workspace owner controls billing, members and keys. Add people as members instead of sharing a sign-in.
  • You may build products and services on the API, paid for with credits or a plan, and serve your own end users with them. You may not resell, sublicense or share raw API access or plan capacity with third parties, whether by giving them keys or through a proxy. You are responsible for your end users' use, and for telling them how their information is handled.

Credits

  • Credits are one of two ways to pay for the API; the other is a plan. Credits are prepaid, bought in USD through Stripe, $10 minimum.
  • Credits never expire. They have no cash value and cannot be transferred to another workspace.
  • Each request is charged at the price listed when it is made, from the workspace's credits.
  • If you turn on auto top-up, we charge your saved card the amount you set whenever credits fall below your threshold, until you turn it off.
  • A request that would take the workspace below zero, or past a key's monthly limit, is refused.

Credits are not refundable, except where the law requires it, where we end this agreement without cause, or where you close your workspace because you do not accept a change to these terms. In those cases we refund unused credits. Credits added by a promotional code were free and are never refunded or paid out. If a payment is reversed or charged back, we may deduct the credits it bought and suspend the workspace until it is settled.

Prices and tax

Prices are in USD per 1M tokens and are listed on the pricing page, per model and per region. The price listed for a model and region when you make a request is the price that request is charged at.

Safe AI Labs is not registered for GST and prices include no GST. If that changes, we say so here and on receipts before it applies. Any other taxes, duties or bank fees in your country are yours to pay.

Plans

A plan is a monthly subscription, in USD through Stripe, that pays for the requests made with the keys it covers. Each plan's page lists its price and its limits. A workspace's API plan covers requests made with its API keys. It does not cover the keys Sail creates when you sign in to it, which have a Sail plan of their own. Requests a plan does not cover are charged to credits.

  • A plan renews automatically each month on the day it started, and we charge the saved card until the plan is cancelled.
  • The workspace owner can cancel from Billing at any time. The plan keeps working to the end of the period already paid for, then ends and is not charged again. Cancel a plan before you delete its workspace.
  • A change from one Sail plan to another, made from Billing, applies at once, and the difference in price for the rest of the period is charged, or credited, on the next invoice. An API plan changes tier by cancelling it and subscribing to the new tier. The new tier starts when you subscribe, and the period already paid for on the old one is not refunded.
  • If a payment fails, Stripe retries it and we email the workspace. The plan keeps working until 7 days after the first failed payment, then stops until the payment goes through.
  • Plan payments are not refunded for part of a period, including when you cancel, except where the Australian Consumer Law requires it, where we end this agreement without cause, or as Fair use below says. Any other refund is at our discretion. If a workspace that already pays for a plan is charged for a second plan, we cancel the second plan and refund its charge.

A plan has no token limit. The tokens its requests use are listed on the usage page and not charged. While an API plan is in force, requests made with the workspace's API keys are not charged to credits, and the credits stay in the workspace for when the plan ends.

An API plan has a cap instead, in output tokens per second, shared by every API key in the workspace. Output tokens count in full and uncached input tokens count at a lower weight, set out on the plan's page. Cached input tokens are free. Over the cap, responses are slowed to it; a request is not refused for the plan. A workspace has a set number of API requests in flight at once, listed on the plan's page; a request over that number waits, and is refused with a retry time only after about 60 seconds of waiting. A Sail plan allows a set number of requests in flight at once, listed on its page, and a request over that number is refused until one finishes. Key rate limits still apply to both.

You may use a plan inside your own products and services, for your own end users. Do not resell, sublicense or share raw API access or a plan's capacity with anyone else, whether by giving them keys or through a proxy that passes their requests on. We may suspend a workspace that does, under Suspension and termination.

Fair use. A plan's tokens are unlimited: a plan has no token limit, and an API plan is paced to its cap in tokens per second. We may limit, slow or suspend a plan whose use is abusive or unlawful, is resold or shared outside the workspace, harms the service for other customers, or is far outside ordinary use of that plan. We email the workspace when we do, and say what we applied. If you do not accept a limit we apply, you can cancel the plan and ask us for a refund of the unused part of the period already paid for, pro rata.

Where we state a speed or priority for a plan, it is a typical figure measured on our fleet and not a guarantee. Speed depends on the model, the region, the length of the request and how busy the region is.

We may change a plan's price. The new price applies from the first renewal at least 30 days after we email you about it. You can cancel before then and pay nothing at the new price.

Acceptable use

Do not use the service to:

  • break the law, or help anyone else break it;
  • create or distribute child sexual abuse material, or content that exploits or harms children;
  • develop malware, or attack, probe or gain access to systems without permission;
  • reach another customer's data or keys, or get around key limits, rate limits or billing;
  • use a Sail plan other than through Sail, such as by sending its key from another client;
  • send load meant to degrade the service for others;
  • supply a person or country under Australian or United States sanctions.

Security research is welcome under the rules on the security page.

Rate limits

Each key has limits on requests and tokens per minute, set out in the docs. A request over a limit is refused with a retry time. We may change the default limits and post the change in the docs.

Your content

You own what you send and the outputs you receive, as far as the law and the model's licence allow. You give us permission to process it only to serve your request.

Prompts and outputs of requests made with an API key are not stored. The chat in your account stores your conversations until you delete them. Neither is used to train a model. The privacy policy says exactly what is kept.

Model outputs can be wrong, incomplete or offensive. Check them before you rely on them, and do not use them as the only basis for a decision about a person's health, safety, legal rights or finances.

You are responsible for having the right to send what you send.

Suspension and termination

You can stop using the service at any time. Deleting your workspace in Settings revokes its keys and ends this agreement.

We may suspend a key or a workspace, straight away if needed, when it breaks these terms, when a payment fails or is reversed, when it puts the service or other customers at risk, or when the law requires it. We email you with the reason, unless the law prevents it, and lift the suspension once the cause is fixed.

We may end this agreement if you break it in a serious way and do not fix it within 14 days of our notice, with unused credits forfeited except where the law requires otherwise. We may also end it for any reason with 30 days' notice, and then refund unused credits and the unused part of a plan's paid month, pro rata.

Availability and changes to the service

We make no uptime or capacity commitment. Capacity in a region varies, and a request may be refused when it is full.

We may add or withdraw models and regions. When we withdraw one you use, we give at least 14 days' notice by email where we can.

Liability

Nothing in these terms excludes, restricts or changes a guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where our liability for failing to meet such a guarantee can be limited, it is limited, at our choice, to supplying the service again or paying the cost of having it supplied again.

Subject to that:

  • the service is provided as is, and we give no other warranty, express or implied;
  • we are not liable for loss of profit, revenue, data or opportunity, or for any indirect or consequential loss;
  • our total liability to you arising from the service is capped at the amount you paid for credits and plans in the 12 months before the claim.

These limits do not apply to liability for fraud, or to death or personal injury caused by negligence.

If you use the service for a business, you cover us for claims by third parties that arise from what you send, how you use outputs, or your breach of these terms.

Changes to these terms

We post changes on this page with the date they take effect. For a change that reduces your rights, we email workspace owners at least 14 days before it applies. Using the service after that date means you accept the change. If you do not accept it, you can close your workspace before the date and we refund unused credits.

Law and general terms

  • These terms are governed by the law of Queensland, Australia, and the courts of Queensland have jurisdiction.
  • They are the whole agreement between us about the service.
  • If a part cannot be enforced, the rest still applies.
  • You may not transfer this agreement without our consent. We may transfer it to a buyer of the business.
  • Neither of us is liable for a delay caused by events outside its reasonable control.
